I am not a regulated immigration adviser
I am a Welfare Benefits Officer. I am not registered with the Immigration Advice Authority (IAA) and I am not a qualified solicitor, barrister, or legal executive.
Under Section 91 of the Immigration and Asylum Act 1999, it is a criminal offence to provide immigration advice or immigration services without being registered with the IAA or being a member of a regulated legal profession. The Border Security, Asylum and Immigration Act 2025 has strengthened these rules further, including new offences for advertising unlawful immigration advice online and fines of up to £15,000 for unregulated advisers .
What I can help with
As an unregulated Welfare Benefits Officer, I can lawfully:
- Help you understand and complete welfare benefits applications and forms
- Help you gather evidence for benefits claims
- Translate documents for benefits purposes
- Provide digital assistance, such as helping you create an account or use an app
- Signpost you to regulated immigration advisers or official GOV.UK guidance
- Accompany you to a meeting with a regulated immigration adviser
These activities are permitted because they relate to welfare benefits, which is not regulated by the IAA. The Immigration Advice Authority’s own guidance confirms that translation, form-filling, digital assistance, signposting, and accompaniment do not require registration, provided the person is not advising on immigration status or requirements.
What I cannot help with
I cannot and will not:
- Advise you on your immigration status or whether your immigration status allows you to claim benefits
- Advise you on your right to reside or whether you have a right to reside for benefits purposes
- Challenge a benefit decision on immigration grounds
- Prepare or submit immigration applications or appeals on your behalf
- Communicate with the Home Office on your behalf regarding immigration matters
- Represent you in immigration tribunal proceedings
These activities constitute immigration advice under the Immigration and Asylum Act 1999 and may only be provided by a person registered with the IAA or a qualified legal professional. If your case involves questions about your immigration status, I will refer you to a regulated immigration adviser.
How to find a regulated immigration adviser
If you need immigration advice, you can:
- Check the IAA Adviser Register to verify whether an adviser is authorised: portal.immigrationadviceauthority.gov.uk/s/adviser-register
- Use the IAA Adviser Finder to locate a registered adviser near you
- Contact Citizens Advice for free, independent advice
The Immigration Advice Authority has launched a national campaign urging the public to “check them before you trust them” when seeking immigration advice. I encourage you to do the same.
